Beware of Fracking

If there is fracking in your state beware. If you do not own the mineral rights to your property they can come in and pretty much do what they want with your property. That means that if need be they can wipe out 20 acres of trees, flood your garden, contaminate your ground water, make your property a trail for loud trucks, etc,. etc,. etc,.. If you do own the mineral rights and the company wants to frack on your property you may get pressured offers (verbal) that are not put down on paper. They will often tell you that all they will do is a little bit of damage when the damage can devalue your property to almost nothing. If all your neighbors sign off for the fracking the company can come in and take your property or do pretty much as they please in terms of fracking.

#1 If you have not purchased the property research to make sure there is not shale on the property.
#2 Make sure that they are not fracking in the area.
#3 Make sure the mineral rights convey to the buyer before you purchase.
#4 Do not sign anything even when threatened and pressured by a company who wants to lease your land. Do not buy the statement that fracking is environmentally safe and they will do little damage to your property.
#5 If you do sign anything make sure it is for the sale of your property at or above what you want for it.

It's easier to slow a fast horse down than to get a dead one going.

Cheaper gas and oil prices do to the fracking boon will likely render a very big price tag long term.

Imagine buying a piece of property out in the country or perhaps growing up there and inheriting it from your parents or grandparents. You have hundred year old trees growing there and fruit trees that you have planted and are reaping the benefits from. You have a large vegetable garden and a stream near by. It is quiet and serene. You own the mineral rights to your property so you are safe from drilling on your property. However, you hear stories about a fracking company coming to your area.
 
    Then one day there is a knock at your door. A friendly gentleman wishes to discuss with you drilling for oil or natural gas on your property.  You state that you are not interested even though he promises a nice financial benefit and a minimal amount of damage to your property. You say," no."  He states that your neighbors have all signed on and you can be made to allow for fracking. As the company has a goodly amount of money and your neighbors are on the side of the company, your attorney tells you that it will cost a great deal of money to fight this in court and you will still probably lose. Not only that but even if you win they can drill just across your  property line anyway. You decide to submit and hope for the best. The agreement you signed says little about any personal financial benefit for you coming from the company. That part was largely verbal.

      A short time later an envoy of big noisy trucks and equipment enter your property. Several acres of your trees are entirely wiped out by excavators. It appears like they are preparing to build a mall on your property. The constant noise is deafening and the track across your property as these trucks run back and forth looks like a war zone. 10 acres of trees are gone and a huge drilling rig and well with a cement pad  soon exists two hundred yards away. You do some research and find that hundreds and hundreds of thousands of gallons of water are used and rendered toxic in this single operation alone. Water is drawn away from your well and you now know why you have low pressure and sometimes no water  pressure. The company provides you with a water tank and hauls water to your property. Then you find that the water coming from your tap contains a lot of salt and is radio active. The company claims that you cannot prove that this was due to their fracking but to keep peace they will make it right with you. In fact they are already hauling water to your tank and keeping it full. The company tells you that the water they contaminate ( millions of gallons) is deposited and left far below your water table so as not to be a big problem. Therefore the contaminated water is largely lost and you learn that often this waste water is leaked when through neglect or accidents the water escapes into your water table.

     Your peaceful country home has become the center of an industrial plant. To sue the company would take far more money than you have. No one wants to buy your property but the company will purchase it for a minimal amount of money. It has been appraised and the value is 25% of its original value. The company is generous and gives you 50% of what it was worth become they came. Then you learn that it is not just water and noise pollution but a substantial amount of air pollution  results from fracking. Its all about $$$.

    These kinds of  issues  and sometimes to a lesser extent are happening all across the country. In the previous link there is a map that shows the areas of fracking. My family is heading into a major fracking zone as we did not research this in advance. We will likely rent while we work there so as to be mobile and not have to deal with these issues on the level of being a land owner.
